The Canadian Charter of Rights and Freedoms

The guarantee of basic fundamental civil liberties is contained within The Canadian Charter of Rights and Freedoms and is applicable to everyone in Canada. Section 7-14 outline the legal rights and deal with such matters as the right to life, liberty and security; the right to be secure against unreasonable search and seizure; the rights of an accused upon arrest; the right of an accused to certain proceedings in criminal and penal matters; and the right not to be subject to cruel and unusual punishment.

Section 7: This section addresses the right to life, liberty and security of the person.

Section 9: States everyone has the right not to be imprisoned or detained arbitrarily.

Section 10: Pertains to rights upon arrest, such as, the right to contact your lawyer and the right to habeas corpus (to be taken before a judge).

Section 12: Protects against cruel and unusual punishment.

Section 13: reads “A witness who testifies in any proceedings has the right not to have any incriminating evidence so given used to incriminate that witness in any other proceedings, except in a prosecution for perjury or for the giving of contradictory evidence.

Section 14: This is the last section of the “legal rights” portion of the charter. It dictates the right to the presence of an interpreter for anyone who does not speak the language or is deaf during any court proceedings.

Canadian Charter of Rights Violation – What Can You Do?
